Ṭalāq
Definition
Talaq is the Islamic mechanism of divorce — the husband's right to dissolve the marriage through a pronouncement, with legal procedures designed to provide time for reconciliation and to protect the wife's rights. Al-Ghazali takes divorce seriously as a legal reality but insists, following the prophetic hadith that it is 'the most hated permissible act to Allah,' that it should be approached with great care, only as a genuine last resort, and never in anger or as a threat. He describes the proper conditions for divorce and emphasises the wife's rights throughout the process — to her mahr, to maintenance during the waiting period, and to be treated with justice and dignity.
